It does not affect the possession or transfer of "assault weapons" lawfully possessed on or before that date. Manufacturers, dealers and individuals may transfer or possess pre-ban "assault weapons" in the same manner as before. To distinguish between "assault weapons" manufactured before the law takes effect, and those manufactured thereafter, the crime bill requires that the date of manufacture be stamped on all "assault weapons" manufactured after the law takes effect. The crime bill labels firearms as "assault weapons" by two methods: name and description. All told, the ban affects more than 175 semi-automatic rifles, pistols and shotguns and revolving cylinder shotguns -- a cross- section of firearms of various sizes, shapes, and calibers/gauges. Guns Banned By Name - Colt AR-15 - Beretta AR-70 (SC70) - Steyr AUG - Action Arms I.M.I. Uzi and Galil - Fabrique Nationale FN-FAL/LAR, FNC - Intratec TEC-9, -DC9, -22 - SWD M-10, -11, -11/9, -12 - Norinco, Mitchell, Poly Technologies Avtomat Kalashnikov ("AK"- type) - Revolving cylinder shotguns, such as (or similar to) the Street Sweeper and Striker 12 - "Copies or duplicates" of the above-named firearms, in any caliber (It is unclear how narrowly or broadly BATF or the courts might interpret "copies or duplicates.") Guns Banned By Description ANY semi-automatic rifle with a detachable magazine and two or more of the following: - Folding or telescoping stock - Flash suppressor - Threaded muzzle - Bayonet mount - Pistol grip that "protrudes conspicuously" beneath the rifle's action - "Grenade launcher" ANY semi-automatic handgun with a detachable magazine and two or more of the following: - Barrel shroud - Threaded muzzle - Magazine that attaches outside the grip - Manufactured weight of 50 ozs. or more when the pistol is unloaded - Is a semi-auto version of a fully-automatic firearm ANY semi-automatic shotgun with two or more of the following: - The ability to use a detachable magazine - Folding or telescoping stock - Fixed magazine over 5 rounds capacity - Pistol grip that "protrudes conspicuously" beneath the shotgun's action "Large Capacity Ammunition Feeding Devices" The "Crime Bill" makes it a Federal crime to possess or transfer a "large capacity ammunition feeding device" manufactured after Sept. 13, 1994. It does not affect such "devices" lawfully possessed previously. Manufacturers, dealers and individuals may possess and transfer pre-ban "devices" the same as before. "Devices" manufactured after the law takes effect must be stamped with the date of manufacture. The law places the "burden of proof" upon the government, not the individual, in the event of a criminal charge relating to private possession of such a "device." Such "devices" are defined as magazines, belts, drums, feed strips or similar devices over 10 rounds capacity, and those that can be readily restored or converted to hold over 10 rounds, except for attached tubular .22 rimfire magazines. (A provision which would have also banned "any combination of parts" from which a "device" over 10 rounds capacity could be made was removed from the bill.) "Armor-Piercing Ammunition" The "Crime Bill" prohibits as "armor-piercing ammunition" any projectile larger than .22 cal. that is "designed and intended for use in a handgun" and the jacket of which has a weight of more than 25% of the projectile's total weight. The "armor piercing ammunition" ban still applies to "a projectile or projectile core which may be used in a handgun" and which is made entirely of hard metals or alloys. Regulations and Requirements on Federal Firearm Licensees The "Crime Bill" requires an FFL applicant to submit fingerprints and photographs to BATF with his application, and send a federal form to his chief local law enforcement officer notifying him of the FFL application. An applicant must certify that "the business to be conducted under the license is not prohibited by State or local law," that no business will be conducted until in compliance with State and local laws, and that such laws will be complied with within 30 days after approval of the FFL. A licensee is required to report to both BATF and local law enforcement the theft or loss of any firearm within 48 hours of discovery, and respond within 24 hours to any BATF request for information concerning the disposition of firearms related to a criminal investigation. BATF is required to notify state and local law enforcement of the names and addresses of persons to whom an FFL is issued, and is authorized to inspect licensees' records "at any time" during a criminal investigation. The law extends to 60 days the period during which BATF must act on FFL applications. Restrictions Concerning "Juveniles" Under 18 Years Of Age The "Crime Bill" prohibits the transfer to, or possession by, a juvenile, of a handgun or handgun ammunition, with certain exceptions. Included are exemptions relating to employment, target practice, hunting, instruction in the safe and lawful handgun use; service with the Armed Forces or National Guard, in defense of self or others against an intruder into the residence of the juvenile or a residence in which the juvenile is an invited guest (though there is no stated exception for other self-defense uses), and under other circumstances with prior written consent of the juvenile's parent or guardian.
