How the New Gun Law Affects You


When does the ban on so-called "assault weapons" take effect?

On the date of the "enactment" of the law, which is the day
President Clinton signs the crime bill into law.  This ban may
last ten years, unless Congress chooses to repeal it sooner.

Do I have to turn in my firearms?

Not yet.  The law "shall not apply to the possession or
transfer of any  semiautomatic assault weapon otherwise lawfully
possessed under Federal law  on the date of the enactment of
this subsection."  The Bureau of Alcohol, Tobacco and Firearms
(BATF) must issue regulations as to how this will be enforced.
Even when those regulations are issued, there will be a time
delay for both public comment and possible Congressional
involvement.

How do I know if one of my firearms is affected?

There is a list of approved firearms in the bill.
  In addition, the law states "The fact that a firearm is
 not listed in Appendix A shall not be construed to  mean
that [the ban] applies to such firearm."   Again, we will
 have to wait for a ruling from the BATF.

Will I be able to sell a banned firearm  or will it to a child?

If you possessed the firearm prior to the date of the
enactment, yes.  The law states that  "It shall be unlawful for
a person to manufacture, transfer, or  possess a semiautomatic
assault weapon.   [This] shall not apply to the possession or
transfer of any  semiautomatic assault weapon otherwise lawfully
possessed under Federal law on the date of the [law's]
enactment."

Will I be allowed to keep my firearms magazines that exceed ten
rounds capacity?

Yes.  The law states "[The magazine ban] shall not
apply to the possession or transfer of any  large capacity
ammunition feeding device otherwise lawfully possessed on or
  before the date of the enactment of this subsection," that
 is, the day President Clinton signed the bill.

Must my magazines be registered?

Not at this time.  The law states "The lack of a
 serial number . . .  shall be a presumption that the
large  capacity ammunition feeding device is not subject
 to the prohibition of possession."
