Mr. Traficant introduced the following bill; which was referred to the
Committee on the Judiciary

                                   A BILL

To establish a commission responsible for making recommendations for laws
that will control crime and formulating a national firearms policy without
denying Second Amendment rights.

     Be it enacted by the Senate and House of Representatives of the United
     States of America in Congress assembled,

SECTION 1. SHORT TITLE.

     This Act may be cited as the `National Firearms Policy Commission
     Act'.

SEC. 2. NATIONAL GUN CONTROL COMMISSION.

     (a) Establishment: There is established a commission to be known as
     the `National Firearms Policy Commission' (in this section referred to
     as the `Commission').

     (b) Duties: The Commission shall formulate a national firearms policy
     and develop recommendations for legislation designed to control crime
     without violating rights provided by the Second Amendment to the
     Constitution of the United States.

     (c) Membership:

          (1) Appointment: The Commission shall be composed of 39 members,
          as follows:

               (A) The Attorney General of the United States.

               (B) 5 Members of the House of Representatives appointed by
               the House of Representatives.

               (C) 5 Senators appointed by the Senate.

               (D) 3 Associate Justices of the Supreme Court of the United
               States, appointed by the Chief Justice of the United States.

               (E) 5 individuals who are not officers of employees of any
               government, appointed by the President of the United States.

               (F) 5 individuals who are not officers of employees of any
               government, appointed by the Senate.

               (G) 5 individuals who are not officers of employees of any
               government, appointed by the House of Representatives.

               (H) 5 individuals who represent organizations that advocate
               responsible firearms ownership, supports the rights of
               Americans to bear firearms , and administers training,
               safety, and education programs on firearms use.

               (I) 5 individuals who represent organizations that represent
               the interests of law enforcement officers.

          (2) Terms: Members shall be appointed for the life of the
          Commission.

          (3) Vacancies: A vacancy in the Commission shall be filled in the
          manner in which the original appointment was made.

          (4) Travel expenses: Members shall serve without pay but shall
          receive travel expenses, including per diem in lieu of
          subsistence, in accordance with subchapter 1 of chapter 57 of
          title 5, United States Code.

          (5) Chairman: The President, in consultation with the Speaker of
          the House of Representatives and the majority leader of the
          Senate, shall designate the chairman of the Commission from among
          its members.

     (d) Commission Panels: The chairman of the Commission may establish
     such panels consisting of members of the Commission as the chairman
     determines appropriate to carry out the duty of the Commission.

     (e) Staff: The Commission may appoint and fix the pay of such
     personnel as it considers appropriate.

     (f) Staff of Federal Agencies: Upon request of the Commission, the
     head of any department or agency of the United States may detail, on a
     reimbursable basis, any of the personnel of that department or agency
     to the Commission to assist it in carrying out its duty.

     (g) Administrative Support Services: Upon the request of the
     Commission or a panel of the Commission, the Secretary of the Treasury
     shall provide the Commission or panel with staff and other support to
     assist the Commission or panel in carrying out its duty.

     (h) Staff and Other Support: Upon the request of the Commission or a
     panel of the Commission, the Secretary of the Treasury shall provide
     the Commission or panel with staff and other support to assist the
     Commission or panel in carrying out its duty.

     (i) Obtaining Official Data: The Commission may secure directly from
     any department or agency of the United States information (other than
     information required by any statute of the United States to be kept
     confidential by such department or agency) necessary for the
     Commission to carry out its duties under this section. Upon request of
     the Commission, the head of that department or agency shall furnish
     such nonconfidential information to the Commission.

     (j) Report: Not later than 6 months after the date initial
     appointments of members to the Commission are completed, the
     Commission shall transmit to the President and the Congress, and make
     public, the recommendations of the Commission.

     (k) Termination: The Commission shall terminate on the 30th day
     following the date of transmittal of the report under subsection (j).
     All records and papers of the Commission shall thereupon be delivered
     by the Administrator of General Services for deposit in the National
     Archives.
