Recently, the Committee approved by a slim margin the text of the gun and magazine bans into the Crime Bill. These provisions will effect far more guns than just the "19" guns that are specifically listed. The generic criteria will apply to roughly 200 guns models. The magazine ban limitation to 10 rounds will apply to even more guns. Even common 9mm pistols like the Berrettas and the Rugers will be effected by the magazine limitations. Not only is this far reaching legislation unconstitutional, but it opens the door for governmental abuse of law-abiding citizens. A similar ban that was enacted in California has resulted in some innocent people being arrested and jailed because the police mistakenly thought that the gun found in their possession was a banned "assault rifle." Needless to say, the California ban has been the subject of lawsuits and may be overturned in the future. Should this ban become law, The Bureau of Alcohol, Tobacco, and Firearms (BATF), will be given even more authority to abuse law-abiding citizens. Some in Congress have called the BATF a "rogue" agency and have actually called for its dismantlement. The BATF has demonstrated its ability to assault law-abiding citizens in recent situations like the Randy Weaver case, and the Branch Davidians in Waco, Texas. Even in my home town in San Diego there was a case recently where federal agents were operating on a bad tip from an informant and nearly shot to death an innocent civilian in his home at midnight in a "Rambo" style raid. After being hospitalized, the civilian has survived and is now suing these government agencies for millions of dollars. The agencies never bothered to verify the informant's tip. The informant later admitted that he was wrong. I ask you, Senator Dole, what guarantees are you willing to make to law-abiding gun owners that they will not be the subject of BATF "Rambo" style raids if this legislation passes? Can you honestly allow this bill to pass knowing the abuses that it will lead to? Please vote no and take steps to filibuster this bill now.
