Governor Miller signed SB299, reforming Nevada's CCW permit system. Also, I just received a copy of the final form of SB299. If I had a scanner, I would scan it for you, but I don't. There are a couple of very important changes to the bill. The first biggee is that the make, model, and caliber of the firearm to be carried must be specified in the application, and are explicit on the permit. The serial number is not mentioned anywhere. No more than two specific types of firearms may be listed on the permit. This isn't great, but it is really not that bad. I read it as saying if I specify "Colt 1911 .45" and "S&W 686 .357" on the permit then I can carry any Colt 1911 in .45. But, a Springfield 1911 would not be permissible. That's a ridiculous fine point, but one I can live with. I could have "Colt 1911 .45" and "Springfield 1911 .45" on the permit, however. SB299 doesn't require the type of firearm to be listed on the course certificate proving firearm competence. The second biggee is that the 2" knife definition has disappeared. This is very good news. This definition in a previous version defined as a dangerous knife any knife with a sharpened blade of more than 2". As a dangerous knife may not be carried concealed, it would outlaw many Swiss Army Knifes, Leatherman Tools, Spydercos, and other utility knives. Anyway, it is gone, and that's what matters. Instead, the phrase "dirk, dagger or dangerous knife" in NRS 202.350 (the old CCW law) will be ammended to read "dirk, dagger or machete." Such knives can not be carried concealed without a permit. The "must issue" CCW reform does not apply to knives, just firearms. The Sheriff still may, at discretion, issue carry permits for knives. How many of those do you think get issued? Oh, no permits will be issued for switchblades, but I believe possesion of one is illegal, anyway. A smaller nit is that concealed carry, even with a permit, is not allowed in "Any other building owned or occupied by the Federal Government, the state or a local government." I believe this is a new, but not horrible provision. This doesn't apply to an employee of any such facility. Regarding expiration, this hasn't changed, but is worth noting: "Unless suspended or revoked by the sheriff who issued the permit, a permit expires on the fifth anniversary of the permitee's birthday, measured from the birthday nearest the date of issuance or renewal." Feb 29 birthdays are considered as Feb 28. I have no idea why they do the renewals on birthdays, instead of based on initial application. The application fee is $60, and in combination with the above expiration period, means that the $60 is good for between 4 and 5 years. Renewal fee is $25. Renewed permits are good for a full 5 years. I see two things to work on for next year: 1) Either or both of: a) Allow nonresidents to apply for permits. b) Honor out of state permits. 2) Explicit state that an unloaded firearm fully enclosed in a case is not a concealed firearm. I have to commend the Legislative Counsel Bureau for mailing out these copies so quickly. I called and asked for it yesterday morning. I guess they received the copies in the afternoon and mailed them out the same day. I believe the current fee for that is $39, so the maximum total amount required is $99. Sorry about that. I'm sure there are other details that I ommitted or got wrong, and this isn't the proper forum, but I wanted to make sure to correct this one bad mistake. Dan.
