We have already defeated some bad legislation, but we have allowed some to slip through one house into the other. ====== FEDERAL ====== The hired hands in the House of Representatives are working hard to get their version of the "You're all terrorists" bill out. There are provisions for banning bullets, allowing warrantless searches and seizures, inserting taggants in explosives and propellants, using the standing army for civilian law enforcement and generally shredding the Constitution in the name of "protection." (You all know what "protection" means, don't you?") This one will class any gun-crime except simple robbery as a terrorist act. This legislation is moving fast, so we need action now. Call or fax your hired hands and give them instructions. HR_1710 is the one receiving all the attention, but let's not forget HR_1635, Gephart's bill "To combat domestic terrorism." Among other things, this bill calls for a study by the DOJ on the use of taggants in explosives. Then, it goes on to make it immediately illegal to possess, manufacture or transfer explosives that don't have taggants included. Representative Paul Gillmor (R-Ohio) has submitted an amendment to a defense spending bill that would turn over the DCM to an independent, non-profit federal corporation. Do you like the way the Post Office is run. Have they been able to make Amtrak run on time? This bill would exempt from waiting periods and other transaction regulations transfers of curio and relic firearms if both parties have a California dealer's certificate of eligibility. A.B. This bill: 1) Divides the crime of armed criminal action into two degrees: Those who carried loaded, concealable firearms with intent to commit a felony would be guilty of an armed criminal action in the first degree Those who carried other unloaded firearms with the requisite intent would be guilty of an armed criminal action in the second degree. A.B. No. 113 Willard Murray. Domestic Anti-Terrorism Program. This bill: 1) Makes findings and declarations regarding domestic terrorism. 2) Appropriates $100,000 from the General Fund to the Los Angeles County Sheriff's Department to enable the department to dedicate specified personnel to participate in investigative and analytical functions necessary to prevent and effectively respond to acts of domestic terrorism in Los Angeles County. 3) Makes the provisions of this bill contingent upon the receipt of federal funding and the passage of the Federal Omnibus Terrorism Bill. A.B. No. 624 Allen. Schools: gun-free school zones. This bill changes the penalty for violating the gun-free school zone law from state prison for 2,3 or 5 years to one year in county jail, or fine or both. A.B. No. 635 Bowler. Firearms: report on use in certain crimes. This bill would require the Attorney General to provide the Legislature with a written report on the specific types of firearms used in the commission of crimes, as specified, based upon information obtained from state and local crime laboratories, on or before April 15 of each year, commencing in 1996. A.B. No. 1397 Poochigian. Violence suppression: illegal weapons: career criminals: criminal street gangs. This bill establishes the Illegal Weapons and Violence Suppression Program to assist state and local law enforcement agencies to identify and apprehend armed career criminals and criminal street gang members involved in violent criminal offenses as well as repeat offenders who utilize weapons, firearms, and explosives. We were talking to a DOJ agent the other day about this. He said the pilot program has been very successful and there is little, if any, fat in this budget. Almost all of the money would go to put agents on the street. This bill would redefine "handgun ammunition" and would define "handgun ammunition designed primarily to penetrate metal or armor," "body vest or shield," and "rifle" for the purposes of this provision. This bill would include any rifle in the law that establishes a prison term enhancement for every person who carries a loaded or unloaded firearm on his or her person, or in a vehicle, during the commission or attempted commission of any street gang crime. I am a little bothered by the Legislative Counsel's question found in the analysis presented to the Assembly Committee on Public Safety: II. SHOULD "HANDGUN AMMUNITION," DEFINED FOR PURPOSES OF THESE SECTIONS AS AMMUNITION PRINCIPALLY FOR USE IN PISTOLS AND REVOLVERS BE REDEFINED TO INCLUDE "AND OTHER FIREARMS CAPABLE OF BEING CONCEALED UPON THE PERSON?" June 15-Passed on file. ===================================================================== ====== LATE NEWS ====== Did you hear that Dr. Arthur Kellerman studied 198 families in Atlanta with federal funds and concluded that half the American population is at risk because they are depending on guns for self defense? Dr. Kellerman states in his report that the sample was too small on which to base any conclusions, including the conclusion he published. US Customs officials will be returning ALL the ammunition seized by the BATF from Eagle Exim last month. Seems that the year-old "tip" was a phony. This means that the 75 million rounds of nasty old Chinese 7.62 x 39 ammo was really good old Russian 7.62 x 39 ammo. In Subcommittee hearings, Senator Arlen Specter asked Ken Adams to provide information on the Militia in America. He seeks to know how many we are, where we are, and such like. Perhaps each of you should send the good Senator your name and address, along with a copy of United States Code 310?
