It was my immediate intention to accept your offer and transfer a considerable amount from another higher interest card. However, much to my dismay, I received information via the Internet that Bank of America is a supporter of Handgun Control, Inc. (HCI), a political action group which engages in political activity to limit and abolish my rights guaranteed under the 2nd Amendment to the Constitution of the United States of America. Specifically Bank of America is listed as a "patron" of an HCI fund raising event to be held June 29th at the Westin St. Francis Hotel in San Francisco. However attractive I found your offer, I cannot in good conscience accept it, or for that matter ever do business with Bank of America as long as it supports fringe political groups like HCI. I am a political activist and an NRA member. Via the Internet I will publicize far and wide the fact that Bank of America supports HCI. I am sure that will not be good for your business. I sincerely hope so. June 2, 1995 Mr. Richard Rosenberg President Bank of America P.O. Box 37000 San Francisco, CA 94137 Dear Mr. Rosenberg: I have been a Bank of America customer for many years, and have quite a number of accounts with your firm. Unfortunately, I am very seriously considering moving all of my accounts to another financial institution. I recently learned that Bank of America is a supporter of Handgun Control, Inc., an anti-gun group which engages in lobbying efforts to pass laws that infringe on rights guaranteed to all of us by our Constitutional Bill of Rights. Despite all of the rhetoric, gun control has been proven to be a farce. The only real answer to the violent crime problem in our country is not more gun control, but criminal control. What is needed is more jail space, stiffer sentences, no plea-bargaining, no parole, no probation. If you do the crime, be assured you'll do the time, and for a very long time. I fail to understand how groups such as Handgun Control can honestly feel that their stated goal of total disarmament of the people, including millions of law-abiding gun owners, is the right way to control crime. I urge you to reconsider your support for Handgun Control, Inc., and any other group that advocates unconstitutional activities. My final decision whether or not to leave BofA rests in your hands. Go to a discount broker and buy 1 share of stock in B of A. Then call up Mr Yarrow. Tell him that you feel as a shareholder, this is an inappropriate and controversial use of corporate funds. If Russ says that they are using private funds, object to the inclusion of the B of A name for those lawyers should know better. If the preceding rhetoric doesn't register with Mr. Yarrow, remind him of what happened when Domino's Pizza gave some money to a player in the abortion debate. That certainly tarnished their image. I then called HCI (415-433-3535) and confirmed with them that they are sponsoring this event with LCAV. I asked if Bank of America was as a sponsor of this event and HCI confirmed that they are. I mentioned to the person who answered that she might want to let Russ Yarrow at BofA know about it. I then called Russ Yarrow to let him know. Moral of the story: When in doubt, check your facts. Bank of America has no position on gun control and we are not a supporter of or contributor to Handgun Control Inc. (HCI). Our name appeared on an invitation to a June 29 dinner in San Francisco sponsored by HCI, because our General Counsel agreed to serve as a co-chair of the dinner. The dinner is being supported by local law firms and attorney groups to memorialize a tragic multiple murder which took place in a law office in San Francisco and had a profound effect on the local legal community. To reiterate, no bank funds are being used to support either the dinner or the organizations that are putting it on. The bank has no position on gun control. Our employees, of course, are free to become involved personally in issues that they believe in, as some employees in our Legal Department have done in this case. Thank you for giving us an opportunity to clarify this issue. We appreciate your business and hope to continue serving you. Now that you are better acquainted with the facts, I hope you will decide to keep your accounts with Bank of America. Public Relations: Mr. Peter Magnani Bank of America VP-Corporate Public Relations Dear Mr. Magnani: I wanted to thank you for your reply to my letter about B of A's involvement with HCI. Can you tell me if it is B of A's policy to allow any employee to use the corporate name for his/her political or social activities? As a professor of forestry, I try to teach my future professionals the proper ethics of when to use and when not to use their employers' letterheads or affiliation in promulgating their activities. The situation with your General Counsel would certainly not be allowable in most corporations. To put it another way, would you allow another employee to use B of A's corporate name in an endeavor involving the National Rifle Association? I think not.
